Section 01

Agreement & Acceptance

By engaging Espace Systems for any service — whether through a booking form, direct message, email, or any other means — you confirm that you have read, understood, and agree to be bound by these Terms & Conditions in full.

These terms constitute the entire agreement between you (the "Client") and Espace Systems (referred to as "we", "us", or "our") with respect to any service provided. No verbal assurances or informal agreements override these written terms.

If you do not agree with any part of these terms, you must not proceed with engaging our services.

Section 02

Scope of Services

Espace Systems provides the following digital services only:

Not included in our services The following are explicitly outside Espace Systems' scope and are not our responsibility under any circumstance:

— Managing or moderating your social media profiles (Instagram, Facebook, X/Twitter, YouTube, etc.)
— Resolving problems on your social media accounts (bans, restrictions, account recovery, etc.)
— Lead generation, digital advertising, or paid media campaigns
— Content creation beyond the initial website build (unless separately agreed in writing)
— Any service not listed above under our offered services

Any request outside the above scope will require a separate written agreement and may incur additional charges. We reserve the right to decline requests outside our service range.

Section 03

Email & Account Details

We strongly recommend that you provide us with your own active, business-connected email address at the start of the project. This ensures you retain full ownership and control of all accounts, platforms, and services set up on your behalf from day one.

If we create an email for you In cases where the client does not have or provide an active email address and requests us to create one for them — Espace Systems will do so as a courtesy. However, we will not be held responsible for any inconvenience, access issues, security problems, or loss of data that occurs after the work is completed and access is handed over. This includes but is not limited to: forgotten passwords, loss of access, email provider restrictions, or account verification issues.

We strongly advise clients to maintain their own email credentials securely and independently of Espace Systems.

Section 04

Free Service Period (Post-Launch Support)

Following the completion and launch of your website, Espace Systems provides one (1) year of complimentary support, included at no additional cost.

What is covered in the free 1-year support period — Adding or replacing images on the website
— Adding customer reviews or testimonials
— Minor text edits and content updates
— Resolving technical issues affecting website functionality
— Basic performance or compatibility fixes

What is not covered under free support — Complete redesigns or structural changes to the website
— Adding entirely new pages or major new features
— SEO strategy overhauls (unless part of an ongoing SEO package)
— Social media management or any out-of-scope services
— Work requiring more than 2–3 hours per request

After the 1-year free support period expires, continued maintenance and support will be available under a separate paid maintenance agreement. Details will be provided prior to the expiry of the free period.

Section 05

Website Security & Hacking

Espace Systems implements industry-standard security practices during the development and deployment of every website, including secure hosting configurations, SSL certificates, security plugins (where applicable), and access control best practices.

Limitation of liability for hacking / security breaches Despite our best efforts, Espace Systems cannot be held responsible for any hacking, data breach, malware injection, or unauthorised access to your website after the project is delivered. If a security incident occurs after handover, it is most likely due to the sharing of login credentials, hosting account details, or admin passwords with unauthorised parties. We will not be liable for any loss of data, business, revenue, or reputation resulting from such incidents.

To protect yourself, we advise:

Any assistance provided in recovering from a hacking incident post-handover will be treated as a new service request and may be billed separately.

Section 06

Google Account Access

In certain cases, Espace Systems may request limited access to your Google account — for example, to set up Google Search Console, Google Analytics, Google Business Profile, or similar services that assist in the website build or SEO configuration.

Our commitment regarding your Google account Espace Systems will not view, download, access, or use any personal files, emails, documents, photos, Drive contents, or any other data within your Google account beyond what is strictly necessary for website creation and setup. Access is used solely for technical configuration purposes and nothing else.

We recommend that clients use Google's built-in sharing and delegation features (such as adding Espace Systems as a verified owner in Search Console) rather than sharing account passwords. This is more secure and limits access appropriately.

Once the relevant setup is complete, you are advised to review and revoke any access permissions granted to third parties, including Espace Systems, at your own discretion.

Payment Terms

Payment for all services must be settled as per the agreed quote prior to or upon project delivery. Specific payment terms are as follows:

Non-payment consequence Failure to make payment within 24 hours of project delivery will result in the domain being disabled and website access being suspended. Espace Systems will not be liable for any business disruption, loss of traffic, or revenue impact during this period.

All prices are agreed upon in writing prior to commencement of work. Any scope changes requested by the client after the project has begun may result in revised pricing, which must be agreed upon before additional work is carried out.

Section 08

Refund Policy

Espace Systems has a limited and clearly defined refund policy. Please read this section carefully before engaging our services.

Website design & development fees — non-refundable The fee charged for website design, development, SEO work, or any creative or technical service is strictly non-refundable once work has commenced. This is because design and development work represents time, effort, and expertise that cannot be recovered.
Domain purchase fee — refundable under conditions If a domain was purchased on your behalf as part of the project and you wish to receive a refund for the domain registration cost, you must notify Espace Systems in writing within 3 weeks (21 days) of the domain purchase date. Refund requests made after this 3-week window will not be accepted, as domain registrars impose their own non-refundable policies beyond this period. Domain refunds are subject to the registrar's own refund policy, and Espace Systems will facilitate the process but cannot guarantee full recovery of all fees in every case.

To request a domain refund, contact us via email or Telegram with your project details and the subject line "Domain Refund Request" within the 3-week window.

Section 09

Uptime, Support & Response Time

Espace Systems is committed to ensuring your website remains live, functional, and performing well throughout our engagement.

Issue resolution commitment In the event of any technical issue, outage, or malfunction affecting your website, Espace Systems will work to resolve the problem within 48 hours of being notified, during the active service or free support period.

No refund for downtime: As long as your website is operational on your domain and we are actively working to resolve any reported issues within the 48-hour window, refund claims based on temporary downtime or performance issues will not be accepted. Temporary issues are a normal part of web hosting and will always be addressed promptly.

To report an issue, contact us via Telegram or email with a description of the problem. We will acknowledge your report and provide an update within 24 hours.

Section 10

Limitation of Liability

To the maximum extent permitted by applicable law, Espace Systems shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of revenue, loss of business, loss of data, or loss of reputation, arising out of or in connection with our services.

Our total liability to any client, in any circumstances, shall not exceed the total amount paid by that client for the specific service in question.

Changes to These Terms

Espace Systems reserves the right to update or modify these Terms & Conditions at any time. Changes will be reflected on this page with an updated effective date. It is your responsibility to review these terms periodically.

Continued use of our services after any changes constitutes your acceptance of the revised terms. For ongoing projects, significant changes will be communicated directly.

Section 13

Penetration Testing & Vulnerability Assessment

This section governs all penetration testing and vulnerability assessment services provided by Espace Systems. By engaging this service — through a booking form, written agreement, digital consent, or any other authorisation method we provide — you confirm that you have read, understood, and fully accept the following terms in addition to all other sections of these Terms & Conditions.

Authorised testing only — mandatory requirement Espace Systems conducts penetration testing exclusively on a fully authorised basis. Testing will not commence unless the client provides explicit, documented authorisation confirming that they are the rightful owner of, or have full legal authority over, the systems, websites, web applications, or digital assets to be tested. Engaging this service without such authority is illegal and will result in immediate termination of the engagement.

13.1 — Authorisation Requirement

Before any testing begins, the client must provide written or verifiable authorisation through one or more of the methods Espace Systems provides. This may include, but is not limited to:

No testing will begin until authorisation is received and verified. Espace Systems reserves the right to request additional proof of ownership (such as domain registrar records, hosting panel access, or official business documents) before proceeding. If satisfactory authorisation cannot be established, we will decline the engagement entirely.

What you receive — Vulnerability Report (PDF) Upon completion of the assessment, Espace Systems will deliver a comprehensive PDF vulnerability report within 24 hours of completing testing. The report will include:

— A summary of all identified vulnerabilities and security weaknesses
— Severity and risk rating for each finding (Critical / High / Medium / Low / Informational)
— A clear explanation of how a malicious actor could exploit each vulnerability, including realistic attack scenarios and potential impact
— Specific, actionable remediation recommendations for each identified issue
— An overall security posture assessment and prioritised action plan

13.2 — Scope of Testing

Testing will be conducted strictly within the scope agreed upon and authorised in writing before the engagement begins. Espace Systems will not test any systems, assets, third-party services, or infrastructure that fall outside the agreed scope — even if vulnerabilities in those systems are discovered incidentally. Any request to expand the scope mid-engagement must be authorised separately in writing.

13.3 — Confidentiality of Vulnerability Data

We will not share, sell, or disclose your vulnerability data All vulnerability findings, report contents, system details, and any sensitive information gathered during the testing engagement are treated as strictly confidential. Espace Systems will not share, sell, publish, disclose, or transfer your vulnerability data or report to any third party under any circumstances, without your explicit prior written consent. This obligation of confidentiality survives the termination of the engagement indefinitely.

Internal records of the engagement (such as notes used to produce the report) are retained solely for the purpose of delivering the agreed service and are not used for any other purpose. We do not use your vulnerability information for marketing, research, or any commercial purpose beyond the contracted service.

13.4 — Non-Destructive Testing Commitment

We will not damage, destroy, or disrupt your systems Espace Systems commits to conducting all testing in a non-destructive manner. Our testing methodologies are designed to identify vulnerabilities without causing data loss, system downtime, corruption, or service disruption. We will not delete, modify, or exfiltrate actual data. Where testing techniques carry any inherent risk of disruption (such as stress or load testing), we will notify you and obtain explicit consent before proceeding with that specific test.

13.5 — Client Responsibility to Remediate

The vulnerability report delivered by Espace Systems is a professional assessment — the responsibility for acting on the findings lies entirely with the client. Espace Systems strongly advises all clients to address identified vulnerabilities as a matter of priority, particularly those rated Critical or High.

Disclaimer — unresolved vulnerabilities If the client fails to remediate the identified vulnerabilities after receiving the report and a real-world attacker subsequently exploits those weaknesses — resulting in data breach, business disruption, financial loss, reputational damage, or any other harm — Espace Systems bears absolutely no responsibility. Our engagement ends upon delivery of the report. We are not liable for any consequences arising from the client's decision not to act on our findings.

13.6 — Legal Compliance

The client warrants that engaging Espace Systems for penetration testing complies with all applicable laws, regulations, and the terms of service of any third-party platforms or hosting providers involved. Espace Systems operates under the principle of responsible disclosure and ethical hacking. We will not engage in any testing that we have reason to believe is unauthorised, illegal, or in violation of third-party agreements — and we reserve the right to halt testing and withdraw from the engagement at any point if we have cause for concern.

13.7 — No Guarantee of Complete Coverage

While Espace Systems will conduct a thorough and professional assessment, no penetration test can guarantee the discovery of every vulnerability. Security testing is a point-in-time assessment and does not account for vulnerabilities introduced after testing concludes, zero-day exploits, or weaknesses outside the agreed scope. The report reflects the state of the system at the time of testing only.

13.8 — Refund Policy for Penetration Testing

Fees paid for penetration testing and vulnerability assessment services are non-refundable once testing has commenced. If the client cancels before testing begins, a partial refund may be considered at Espace Systems' sole discretion, minus any preparation or scoping costs already incurred.
